Common use of Licensed Biological Materials Clause in Contracts

Licensed Biological Materials. The term “Licensed Biological Materials” shall mean the materials identified in Exhibit A and supplied by TSRI to Licensee, together with any progeny or mutants of such materials, or unmodified derivatives of such materials (defined as substances created by Licensee that constitute an unmodified functional sub-unit or product expressed by such materials).

Licensed Biological Materials. The term “Licensed Biological Materials” shall mean (i) the materials identified in Exhibit A and to be supplied by TSRI to LicenseeTSRI, together with as identified using the process more particularly described in Section 2 (Delivery) below, (ii) any progeny or mutants of such materialsprogeny, mutants, or unmodified derivatives of such materials thereof supplied by TSRI, and (defined as substances iii) any progeny, mutants or derivatives thereof created by Licensee that constitute an unmodified functional sub-unit or product expressed by such materials)Licensee.

Licensed Biological Materials. The term “Licensed Biological Materials” shall mean the materials supplied by TSRI (identified in Exhibit A and A) together with any progeny, mutants, or derivatives thereof supplied by TSRI to Licensee, together with any progeny or mutants of such materials, or unmodified derivatives of such materials (defined as substances created by Licensee that constitute an unmodified functional sub-unit Licensee. All Licensed Biological Materials shall be deemed TSRI’s Confidential Information whether or product expressed by such materials)not marked as “confidential”.
