Service Provider's failure to observe or perform any duties or obligations to be observed or performed by Service Provider under Third Party Materials licenses, Equipment Leases or Third Party Contracts used by Service Provider to provide the Services (other than Third Party Materials Service Provider is required to use by another DCS Service Provider pursuant to a license held by such other DCS Service Provider), including any action undertaken by DIR or a DIR in conformity with the request or direction of Service Provider with respect to any such license, lease or contract, including pursuant to Section 6.6(a).
