Common use of Lien Clause in Contracts

Lien. “Lien” means any lien, mortgage, pledge, encumbrance, charge, security interest, adverse claim, liability, interest, charge, preference, priority, proxy, transfer restriction (other than restrictions under the 1933 Act and state securities laws), encroachment, tax, order, community property interest, equitable interest, option, warrant, right of first refusal, easement, profit, license, servitude, right of way, covenant or zoning restriction.

Lien. “Lien” means any lien, mortgage, pledge, encumbrancelien, charge, claim, security interest, adverse claimclaims of ownership or use, liabilityrestrictions on transfer, interestdefect of title or other encumbrance of any sort, charge, preference, priority, proxy, transfer restriction (other than restrictions under the 1933 Act (a) mechanic’s, materialmen’s, and state securities laws)similar liens with respect to any amounts not yet due and payable, encroachment, tax, order, community property interest, equitable interest, option, warrant, right of first refusal, easement, profit, license, servitude, right of way, covenant or zoning restrictionand (b) liens for taxes not yet due and payable.
