Common use of Lien Clause in Contracts

Lien. “Lien” shall mean and refer to any mortgage, lien, security interest, encumbrance, charge on, pledge of, conditional sale or other encumbrance on the Property, Project or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operations.

Lien. “Lien” shall mean and refer mean, with respect to any asset (real, personal or mixed): (a) any mortgage, pledge, lien, easement, lease, title defect or imperfection or any other form of security interest, encumbrance, charge on, pledge of, whether imposed by Law or by contract; and (b) the interest of a vendor or lessor under any conditional sale agreement, financing lease or other encumbrance on the Property, Project or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationstitle retention agreement relating to such asset.

Lien. “Lien” shall mean and refer to any mortgage, liendeed of trust, security interestpledge, hypothecation, deposit arrangement, encumbrance, lien (statutory or other), charge onor other security interest or any preference, pledge of, priority or other security agreement or preferential arrangement of any kind or nature whatsoever (including any conditional sale or other encumbrance on the Property, Project or Premises title retention agreement and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationscapital lease having substantially the same economic effect as any of the foregoing).

Lien. The term “Lien” shall mean and refer to (a) any encumbrance, mortgage, pledge, lien, charge or other security interestinterest of any kind upon any Property, encumbrance, charge on, pledge of, or upon the income or profits therefrom; (b) any acquisition of or agreement to have an option to acquire any Property or assets upon conditional sale or other encumbrance on title retention agreement, device or arrangement (including a capitalized lease); or (c) any sale, assignment, pledge or other transfer for security by the PropertyCompany or any of its Subsidiaries of any accounts, Project general intangibles or Premises and any Alterationchattel paper, fixture, improvement with or appurtenance thereto arising by or through Tenant or Tenant's Operationswithout recourse.

Lien. “Lien” shall mean and refer mean, with respect to any asset: (a) any mortgage, pledge, lien, charge, claim, restriction, easement, covenant, lease, encroachment, title defect, imposition, security interest, encumbrance, charge on, pledge of, conditional sale interest or other encumbrance on of any kind; and (b) the Propertyinterest of a vendor or lessor under any conditional sale agreement, Project financing lease or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationsother title retention agreement relating to such asset.

Lien. “Lien” " shall mean and refer mean, with respect to any asset (real, personal or mixed): (a) any mortgage, pledge, lien, easement, lease, title defect or imperfection or any other form of security interest, encumbrance, charge on, pledge of, whether imposed by Law or by Contract; and (b) the interest of a vendor or lessor under any conditional sale agreement, financing lease or other encumbrance on the Property, Project or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationstitle retention agreement relating to such asset.

Lien. “Lien” shall mean and refer to means any mortgage, deed of trust, pledge, hypothecation, assignment, deposit arrangement, lien, security interest, encumbrancecharge, charge onor other encumbrance of any kind, pledge ofwhether consensual or not, or any other type of preferential arrangement that has substantially the same practical effect as a lien or a security interest, including, without limitation, any conditional sale or other encumbrance on title-retention agreement or the Property, Project interest of a lessor under a capital lease or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationsfinancing lease.

Lien. “Lien” shall mean and refer mean, with respect to any asset: (a) any mortgage, pledge, lien, charge, claim, restriction, reservation, condition, easement, covenant, lease, encroachment, title defect, imposition, security interest, encumbrance, charge on, pledge of, conditional sale interest or other encumbrance on of any kind; and (b) the Propertyinterest of a vendor or lessor under any conditional sale agreement, Project financing lease or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationsother title retention agreement relating to such asset.

Lien. “Lien” shall mean and refer to any mortgage, lien, security interest, encumbrance, charge on, pledge of, conditional sale or other encumbrance on the Property, Project or Licensed Premises and any Alterationalteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationsthereto.

Lien. “Lien” shall mean and refer to any mortgage, lien, security interest, encumbrance, charge on, pledge of, conditional sale or other encumbrance on the Property, Project or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through any Tenant Party or Tenant's Tenant Operations.

Lien. “Lien” shall mean and refer to any mortgage, lien, security interest, encumbrance, charge on, pledge of, conditional sale or other encumbrance on the PropertyPremises or the Initial Improvements, Project or Premises and Midterm Refurbishment, any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationsthereto.

Lien. “Lien” shall mean and refer to Lien means any mortgage, lienpledge, security interest, encumbrance, lien, or charge onof any kind, pledge ofincluding without limitation any agreement to give or not to give any of the foregoing, any conditional sale or other encumbrance on title retention agreement, and the Property, Project filing of or Premises and agreement to give any Alteration, fixture, improvement financing statement or appurtenance thereto arising by or through Tenant or Tenant's Operationsother similar form of public notice under the laws of any jurisdiction.

Lien. “The term "Lien” " shall mean and refer to any mortgage, leasehold mortgage, pledge, assignment, lien, charge, attachment, execution, encumbrance or security interestinterest of any kind whatsoever, encumbrancewhether consensual or by judicial process or the interest of a vendor or lessor under a conditional sale, charge on, pledge of, conditional sale title retention or other encumbrance on the Property, Project or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationscapital lease agreement.

Lien. “Lien” shall mean and refer to Lien means any mortgage, deed of trust, deed to secure debt, lien, charge, restriction, pledge, security interest, encumbranceoption, charge onlease or sublease, pledge ofclaim, conditional sale right of any third party, easement, encroachment or encumbrance or other encumbrance on the Property, Project charges or Premises and rights of others of any Alteration, fixture, improvement kind or appurtenance thereto arising by or through Tenant or Tenant's Operationsnature.

Lien. “Lien” shall mean and refer mean, with respect to any asset (real, personal or mixed): (a) any mortgage, pledge, lien, easement, lease, title defect or imperfection or any other form of security interestShare, encumbrance, charge on, pledge of, whether imposed by Law or by contract; and (b) the Share of a vendor or lessor under any conditional sale agreement, financing lease or other encumbrance on the Property, Project or Premises and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationstitle retention agreement relating to such asset.

Lien. “Lien” shall mean and refer to any mortgage, lien, security interest, encumbrance, charge on, pledge of, conditional sale or other encumbrance on the PropertyPremises or the Initial Improvements, Project or Premises and Midterm Refurbishment, any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's Operationsimprovement.

Lien. “Lien” shall mean and refer to " means any mortgage, lienpledge, security interesthypothecation, ---- assignment, deposit arrangement, encumbrance, lien (statutory or other), charge onor other security interest or any preference, pledge ofpriority or other security agreement or preferential arrangement of any kind or nature whatsoever (including, without limitation, any conditional sale or other encumbrance on the Property, Project or Premises title retention agreement and any Alteration, fixture, improvement or appurtenance thereto arising by or through Tenant or Tenant's OperationsCapital Lease having substantially the same economic effect as any of the foregoing).

Lien. “Lien” shall mean and refer to any mortgage, lien, security interest, encumbrance, charge on, pledge of, conditional sale or other encumbrance on the Property, Project Premises or Premises and any Alteration, fixture, improvement or appurtenance thereto arising the ownership of which is retained by or through Tenant or Tenant's Operationsthe Port.
