Common use of Limit of indemnity Clause in Contracts

Limit of indemnity. Our liability under this section in respect of any one claim shall not exceed the amount stated as the limit of indemnity in the schedule exclusive of defence costs that will be payable in addition to the limit of indemnity unless such defence costs are expressly stated in any clause as included within the limit of indemnity. Where provided, the limit of indemnity in respect of North America will always be in the aggregate inclusive of defence costs and the limit granted is deemed to be part of and not in addition to the overall policy limit of indemnity specified in the schedule.
