Common use of Limit of indemnity Clause in Contracts

Limit of indemnity. The liability of the Underwriter shall not exceed during the Defects Insurance Period and/or the Structural Insurance Period the amount shown as the Sum Insured on the Certificate of Insurance or the relevant limit in the Financial Limit section of this Policy, whichever is the lesser. The Limit of Indemnity is index linked in accordance with Condition 5 of the Policy.
