Common use of Limit on Subrogation; Waivers Clause in Contracts

Limit on Subrogation; Waivers. a. Except as provided in clause (b) below, no payment made by or for the account of any Guarantor pursuant to this Guaranty shall entitle any Guarantor by subrogation or otherwise to any payment by any Borrower or from or out of any property of any Borrower, and no Guarantor shall exercise any right or remedy against any Borrower or any property of any Borrower by reason of any performance by such Guarantor of this Guaranty, all of which rights and remedies are hereby waived by such Guarantor to the fullest extent permitted by Applicable Law.
