Common use of LIMITATION OF LIABILITY 24 Clause in Contracts

LIMITATION OF LIABILITY 24. 1 The Service Provider shall be liable for any damages and/or losses and/or claims of whatsoever nature howsoever arising incurred and/or suffered by the Post Office as a result of any breach of the Agreement whether in contract, delict or otherwise or arising as a result of negligence, wilful default or otherwise of the Service Provider and/or its employees and/or agents and/or sub- contractors and or any other third party related to the Service Provider and the provision of the Services. 24.2 The Service Provider’s total liability in terms of the Agreement shall be limited to three (3) times the amount actually paid by the Post Office to the Service Provider under the Agreement.
