Common use of LIMITATION OF LIABILITY 24 Clause in Contracts

LIMITATION OF LIABILITY 24. 1 The Service Provider shall be liable for any damages and/or losses and/or claims of whatsoever nature howsoever arising incurred and/or suffered by the Post Office as a result of any breach of the Agreement whether in contract, delict or otherwise or arising as a result of negligence, wilful default or otherwise of the Service Provider and/or its employees and/or agents and/or sub- contractors and or any other third party related to the Service Provider and the provision of the Services.

LIMITATION OF LIABILITY 24. 1 The Service Provider shall be liable for any damages and/or losses and/or claims of whatsoever nature howsoever arising incurred and/or suffered by the Post Office Postbank as a result of any breach of the Agreement whether in contract, delict or otherwise or arising as a result of negligence, wilful default or otherwise of the Service Provider and/or its employees and/or agents and/or sub- sub-contractors and or any other third party related to the Service Provider and the provision of the Services.
