Common use of Limitation of Liability of the Administrator Clause in Contracts

Limitation of Liability of the Administrator. The Administrator shall not be liable for any error of judgment or mistake of law or for any act or omission in the administration or management of any Trust or the performance of its duties hereunder, except for willful misfeasance, bad faith or gross negligence in the performance of its duties, or by reason of the reckless disregard of its obligations and duties hereunder. As used in this Section 4, the term "Administrator" shall include the Administrator and/or any of its affiliates and the directors, officers and employees of the Administrator and/or any of its affiliates.

The In the absence of willful misfeasance, bad faith, gross negligence or reckless disregard of obligations or duties hereunder on the part of the Administrator, the Administrator shall not be liable for subject to liability to the Trust or to any error shareholder of judgment or mistake of law or the Trust for any act or omission in the administration course of, or management connected with, rendering services hereunder or for any losses which may be sustained in the purchase, holding or sale of any Trust security or the performance of its duties hereunderother instrument, except for willful misfeasance, bad faith or gross negligence in the performance of its duties, or by reason of the reckless disregard of its obligations including options and duties hereunder. As used in this Section 4, the term "Administrator" shall include the Administrator and/or any of its affiliates and the directors, officers and employees of the Administrator and/or any of its affiliatesfutures contracts.
