Common use of LIMITATION ON ALLOCATIONS Clause in Contracts

LIMITATION ON ALLOCATIONS. If the Employer maintains or has ever maintained another qualified defined contribution plan other than a Xxxxxxx Profit Sharing Plan (Plan number 001 or 003) or a plan amended into the Prototype Plan in which any Participant in this Plan is or was a participant or could possible become a participant, the provisions of Section 5.03 of the Prototype Plan will apply. If the Employer maintains or has ever maintained a qualified defined benefit plan in which any Participant in this Plan is or was a participant or could possibly become a participant, the provisions of Section 5.04 of the Prototype Plan will apply.
