Common use of Limitation on Amount Clause in Contracts

Limitation on Amount. The Issuing Bank shall not be obligated or permitted under this Section 3.1 to issue any Letter of Credit for the account of the Borrower to the extent that the sum of (a) the amount that would be available to be drawn under the proposed Letter of Credit plus (b) the sum of all amounts available to be drawn under outstanding Letters of Credit plus (c) any Unreimbursed Drawings would exceed the lesser of (i) the Letter of Credit Sublimit and (ii) the excess of the Commitment over the aggregate principal amount of the RC Loans and Swing Loans then outstanding.

The Issuing Bank shall not be obligated or permitted under this Section 3.1 2.03 to issue any Letter of Credit for the account of the Borrower any Borrower, to the extent that the sum of (ai) the amount that would be available to be drawn under the proposed Letter of Credit Credit, plus (bii) the sum of all amounts available to be drawn under all outstanding Letters of Credit Credit, plus (ciii) any Unreimbursed Drawings Drawings, would exceed the lesser of (iA) the Letter of Credit Sublimit Sublimit, and (iiB) the excess of the Commitment Revolving Credit Facility Amount over the aggregate principal amount of the RC Revolving Credit Loans and Swing Loans then outstanding.
