Common use of Limitation on Buyer’s Liability Clause in Contracts

Limitation on Buyer’s Liability. Buyer will not be liable under any circumstances for consequential, incidental, or special damages of any kind or for damages in excess of the price allowable to the portion of the Products or Services on which the claim is based. Action on any claim against Buyer must commence within one year after the cause of action has accrued.
