LIMITATION ON DAMAGES RECOVERABLE. If, notwithstanding the above limitations on liability, OBMC should be determined to be liable to Owner for damages to persons or property, OBMC liability shall be limited to a sum equal to Owner’s applicable insurance deductible actually paid by Owner in each instance.
