Limitation on Liability for Liquidated Damages. The aggregate liability of Design- Builder in relation to liquidated damages assessed pursuant to Section 11.2 shall not exceed three percent (3%) of the Contract Price, as such price may be adjusted in accordance with this Agreement (the “Liquidated Damages Liability Cap”).
