Common use of Limitation on Payment of Funding Clause in Contracts

Limitation on Payment of Funding. Despite section 4.1, the Funder: (a) will not provide any funds to the HSP until this Agreement is fully executed; (b) may pro-rate the Funding if this Agreement is signed after the Effective Date; (c) will not provide any funds to the HSP until the HSP meets the insurance requirements described in section 10.4; (d) will not be required to continue to provide funds, (1) if the Minister or the Director so directs under the terms of the Act; (2) while the Home is under the control of an interim manager pursuant to section 157 of the Act; or (3) in the event the HSP breaches any of its obligations under this Agreement until the breach is remedied to the Funder’s satisfaction; and (e) upon notice to the HSP, may adjust the amount of funds it provides to the HSP in any Funding Year pursuant to Article 5.

Despite section 4.1, the Funder: (a) LHIN: will not provide any funds to the HSP until this Agreement is fully executed; (b) ; may pro-rate the Funding if this Agreement is signed after the Effective Date; (c) ; will not provide any funds to the HSP until the HSP meets the insurance requirements described in section 10.4; (d) 11.4 in respect of each Home; will not be required to continue to provide funds, (1) funds in respect of a Home, if the Minister or the Director so directs under the terms of the Act; (2) ; 18/42 while the Home is under the control of an interim manager pursuant to section 157 of the Act; or (3) or in the event the HSP breaches any of its obligations under this Agreement until the breach is remedied to the FunderLHIN’s satisfaction; and (e) and upon notice to the HSP, may adjust the amount of funds it provides to the HSP in any Funding Year in respect of a Home pursuant to Article 5.
