Common use of Limitation on Third Party Beneficiaries Clause in Contracts

Limitation on Third Party Beneficiaries. It is not intended by any of the provisions of the Preconstruction Services Contract to create any third- party beneficiary hereunder, or to authorize anyone not a party hereto to maintain a suit for personal injury or property damage pursuant to the terms or provisions hereof. Except as otherwise provided, the duties, obligations and responsibilities of the parties to the Preconstruction Services Contract with respect to third parties shall remain as imposed by law. The Preconstruction Services Contract shall not be construed to create a contractual relationship of any kind between Department and a Subcontractor or any other person except Construction Manager.
