Limitation Periods for Representations and Warranties. Notwithstanding the provisions of the Limitation Act (British Columbia) (the “Limitation Act”) or any other statute, an Indemnified Party may commence a proceeding in respect of Damages arising from any incorrectness in or breach of any representation and warranty of the Indemnifying Party as referred to in a Claim Notice delivered within the time periods stipulated in Section 6.5 at any time on or before the later of: (a) the second anniversary of the last date upon which such Claim Notice is permitted to be delivered under Section 6.5; and (b) the expiry of the limitation period otherwise applicable to such claim, and any applicable limitation period is hereby extended to the full extent permitted by law.
