Limitations and Exceptions. (1) Contracting Parties may, in their national legislation, provide for the same kinds of limitations or exceptions with regard to the protection of performers and producers of phonograms as they provide for, in their national legislation, in connection with the protection of copyright in literary and artistic works. (2) Contracting Parties shall confine any limitations of or exceptions to rights provided for in this Treaty to certain special cases which do not conflict with a normal exploitation of the performance or phonogram and do not unreasonably prejudice the legitimate interests of the performer or of the producer of the phonogram.14,15

Limitations and Exceptions. Personal leave for days immediately preceding or following a vacation or holiday, or for the opening day or closing day of the school year, or from May 20 to the last day of school, shall be approved by the Superintendent or designee if the situation is one in which the employee does not have control or cannot reasonably make other arrangements. If leave is to be requested on any of the aforementioned days, the employee shall be obligated to submit the Employee Leave Certification Form (Appendix C) including a written statement of the nature of the reason for leave in sufficient detail to establish that it is a matter over which the employee does not have control or cannot reasonably make other arrangements.

For greater certainty, a Party may adopt or maintain limitations or exceptions to the rights referred to in paragraph 1 for fair use, as long as any such limitation or exception is confined as stated in paragraph 1.
