Statutory Requirements. This Agreement is subject to the requirements of Chapter 2.2 of Division 2 of the California Health and Safety Code and Title 28 of the California Code of Regulations. Any provision required to be in this Agreement by reason of such laws shall be binding upon Blue Shield whether or not such provision is actually included in this Agreement. In addition, this Agreement is subject to applica- ble state and federal statutes and regulations. Any provision required to be in this Agreement by rea- son of such state and federal statutes shall bind the Subscriber and Blue Shield whether or not such provision is actually included in this Agree- ment.
Statutory Requirements. This Contract is subject to the requirements of the Xxxx-Xxxxx Health Care Service Plan Act, Chapter 2.2 of Division 2 of the California Health and Safety Code and Title 28 of the California Code of Regulations. Any provision required to be in this Contract by reason of the Act or Regulations shall bind Blue Shield whether or not such provision is actually included in this Contract. In addition, this Contract is subject to applicable state and federal statutes and regulations, which may include the Employee Retirement Income Security Act, Health Insurance Portability and Accountability Act (“HIPAA”) and applicable Centers for Medicare and Medicaid Services (“CMS”) requirements. Any provision required to be in this Contract by reason of such state and federal statutes shall bind the Group and Blue Shield whether or not such provision is actually included in this Contract.
Statutory Requirements. All statutory requirements for the valid consummation by the Company of the transactions contemplated by this Agreement shall have been fulfilled. All authorizations, consents and approvals of all governments and other persons required to be obtained in order to permit consummation by the Company of the transactions contemplated by this Agreement shall have been obtained.
Statutory Requirements. 24.1 The CONTRACTOR shall notify the CUSTOMER of all statutory provisions and approved safety standards applicable to the Ordered IT Products and their provision and shall be responsible for obtaining all licences, consents or permits required for the performance of this Contract.
24.2 The CONTRACTOR shall inform the CUSTOMER if the Ordered IT Products are hazardous to health or safety and of the precautions that should be taken in respect thereto.
24.3 The CONTRACTOR shall, and shall ensure that its Sub-Contractors and the CONTRACTOR Personnel, take all measures necessary to comply with the requirements of the Health and Safety at Work etc. Act 1974 and any other Laws relating to health and safety, which may apply to those involved in the performance of this Contract.
Statutory Requirements. If FTA enters into an Early System Work Agreement (ESWA) with the Recipient to advance the implementation of the Recipient’s Capital Project, the Recipient agrees that the provisions of 49 U.S.C. § 5309(k)(3) will apply to that ESWA, the Recipient, and FTA.
Statutory Requirements. All statutory requirements for the valid consummation by the Shareholders of the transactions contemplated by this Agreement shall have been fulfilled.
Statutory Requirements. 11.1 The Provider shall be responsible for obtaining all licences, authorisations, consents or permits required in relation to the performance of this Framework Agreement and any Call-Off Contract. The Provider warrants and represents that, from the commencement date of any Call-Off Contract it shall have all necessary licences, authorisations, consents or permits and shall be fully compliant with all applicable law in supplying the Services.
Statutory Requirements. The cost of carrying out any further works (after the initial construction in accordance with statutory requirements) to the Estate Common Areas required to comply with any statute.
Statutory Requirements. 15.1 The Organisation shall conform to all existing and new legislation, which may be applicable to this Agreement.
Statutory Requirements. All existing and future rates, taxes, charges, assessments and outgoings payable to any competent authority or for utilities except in respect of the Lettable Units.
