Common use of Limitations on Indemnifiable Damages Clause in Contracts

Limitations on Indemnifiable Damages. Notwithstanding the foregoing, the Indemnitees shall not be entitled to recover Indemnifiable Damages for any matter described in Section 6.1 hereof unless and until the aggregate of all claims for Indemnifiable Damages asserted pursuant to Section 6.1 hereof exceeds $50,000 (the “Deductible”), provided that if such claims exceed the Deductible in the aggregate, the Indemnitees shall be entitled to recover all amounts of Indemnifiable Damages.
