Common use of Limitations on Substitutions and Repurchases Clause in Contracts

Limitations on Substitutions and Repurchases. (a) Any repurchase of any Transferred Loan from the Buyer to the Seller and any substitution effected pursuant to Section 6.2(a) shall be conducted on an arm’s length basis and shall be on material terms no less favorable to the Buyer than would be the case if the Seller were not an Affiliate of the Buyer or as otherwise expressly permitted in this Agreement.
