Limitations on Use. No part of the moneys delivered to the Recipient pursuant to Section II hereof is being or will be used to refinance, retire, redeem, or otherwise pay debt service on all or any part of any part of any governmental obligations regardless of whether the interest on such obligations is or was excluded from gross income for federal income tax purposes unless prior approval by the Director is given.
Limitations on Use. Each Party shall use, and cause each of its Affiliates, its licensees and its sublicensees to use, any Confidential Information obtained by such Party from the other Party, its Affiliates, its licensees or its sublicensees, pursuant to this Agreement or otherwise, solely in connection with the activities or transactions contemplated hereby.
Limitations on Use. Notwithstanding any other provisions in this Agreement, except with the written consent of Verisign, Registrar shall not: (i) sublicense the Licensed Product or otherwise permit any use of the Licensed Product by or for the benefit of any party other than Registrar, (ii) publish, distribute or permit disclosure of the Licensed Product other than to employees, contractors, and agents of Registrar for use in Registrar's domain name registration business, (iii) decompile, reverse engineer, copy or re-engineer the Licensed Product for any unauthorized purpose, (iv) use or permit use of the Licensed Product in violation of any federal, state or local rule, regulation or law, or for any unlawful purpose. Registrar agrees to employ the necessary measures to prevent its access to the System granted hereunder from being used to (i) allow, enable, or otherwise support the transmission by e-mail, telephone, or facsimile of mass unsolicited, commercial advertising or solicitations to entities other than Registrar's customers; or (ii) enable high volume, automated, electronic processes that send queries or data to the systems of Verisign, any other registry operated under an agreement with ICANN, or any ICANN- Accredited Registrar, except as reasonably necessary to register domain names or modify existing registrations in accordance with any Operational Requirements.
Limitations on Use. 4.1. Licensee may use the Software only for Licensee's internal business purposes and only in accordance with the Documentation. Any other use of the Software is strictly prohibited. Without limiting the general nature of these restrictions, Licensee will not make the Software available for use by third parties on a "time sharing," "application service provider," or "service bureau" basis or for any other similar commercial rental or sharing arrangement.
4.2. Licensee will not, and will not allow or enable any third party to: (i) reverse engineer, disassemble, peel components, decompile, reprogram or otherwise reduce the Software or any portion to a human perceptible form or otherwise attempt to recreate the source code; (ii) modify, adapt, create derivative works of, or merge the Software; (iii) copy, reproduce, distribute, lend, or lease the Software or Documentation to any third party, grant any sublicense or other rights in the Software or Documentation to any third party, or take any action that would cause the Software or Documentation to be placed in the public domain; (iv) remove, or in any way alter or obscure, any copyright notice or other notice of Motorola's proprietary rights; (v) provide, copy, transmit, disclose, divulge or make the Software or Documentation available to, or permit the use of the Software by any third party or on any machine except as expressly authorized by this Agreement; or (vi) use, or permit the use of, the Software in a manner that would result in the production of a copy of the Software solely by activating a machine containing the Software. Licensee may make one copy of Software to be used solely for archival, back- up, or disaster recovery purposes; provided that Licensee may not operate that copy of the Software at the same time as the original Software is being operated. Licensee may make as many copies of the Documentation as it may reasonably require for the internal use of the Software.
4.3. Unless otherwise authorized by Motorola in writing, Licensee will not, and will not enable or allow any third party to: (i) install a licensed copy of the Software on more than one unit of a Designated Product; or (ii) copy onto or transfer Software installed in one unit of a Designated Product onto one other device. Limitations on Use. You agree not to transfer, sell, rent, lease, publish or otherwise distribute copies of the Program or Documentation to others including individuals internal or external to your own organization.
Limitations on Use. Except to the extent permitted by applicable law, Customer shall not (i) make more copies of the Software than required for use (except for a reasonable number of copies for archival purposes) or use any unlicensed versions of the Products; (ii) use any Products that are not listed in an Order even if such unlicensed software is made available to Customer as part of Company's general delivery mechanisms;
Limitations on Use. The Product/Service is licensed, not sold. Inogic reserves all other rights not expressly granted. While using the Product/Service, the Customer shall not do the following:
(i) use the Product/Service in any way that xxxxx Product/Service or its resellers, distributors and/or vendors, or any Customer of a Product/Service;
(ii) work around any technical limitations in the Product/Service that only allows the Customer to use it in certain ways;
(iii) reverse engineer, decompile or disassemble the Product/Service;
(iv) remove, minimize, block, or modify any notices of Inogic or its suppliers in the Product/Service;
(v) use the Product/Service in any way that is against the law or to create or propagate malware;
(vi) share, publish, distribute, or lend the Product/Service, provide the Product/Service to third parties as a stand-alone hosted solution for others to use, or transfer the Product/Service or this XXXX to any third party. Evaluation versions available for download from Inogic's websites may be freely distributed.
(vii) rent, lease, lend, resell, or host to or for third parties any Product/Service;
(viii) use any portion of the Product/Service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages ("spam");
(ix) use any unauthorized automated process or service to access and/or use the Product/Service (such as a BOT, a spider, periodic caching of information stored by Product/Service or "meta-searching"), however, periodic automated access to the Product/Service for report creation or scheduling is permitted;
(x) use any unauthorized means to modify or reroute, or attempt to modify or reroute, the Product/Service or work around any of the technical limitations in the service; and
(xi) build a product or service using similar ideas, features, functions or graphics of the Product/Service.
(xii) While using the Product/Service, the Customer shall do the following: ✓ comply with all the Applicable Laws; ✓ comply with any codes of conduct or other notices in writing provided by Inogic to the Customer; and ✓ promptly notify Inogic if it learns of a security breach or unauthorized access related to the Product/Service.
Limitations on Use. We may refuse to process any transaction that we believe may violate the law or the terms of this Agreement. Your transaction may be denied if you (i) use the Card at unlawful domestic or international gambling web sites, or at payment processors supporting unlawful gambling web sites, or to purchase illegal goods or services; (ii) exceed the transaction limitations described in this Agreement, (2) do not have adequate funds available in your Card Account for the transaction, (iii) do not enter the correct PIN, or (iv) we otherwise have reason to believe the transaction is fraudulent or not in compliance with the terms of this Agreement. Except as otherwise stated in this Agreement, you do not have the right to stop payment on any purchase or withdrawal originated through your Card.
Limitations on Use. You may not use, copy, modify, or distribute the Product, or make any copy, adaptation, transcription, or merge any portion thereof, unless expressly authorized by Gurobi in a separate written agreement. You may not reverse assemble, reverse compile, translate, or reverse engineer the Product. Your Product License may not be sold, transferred, leased, assigned, or sub-licensed without Gurobi’s prior written consent. If You copy or modify the Product in any way not expressly authorized by Gurobi, Your Product License is automatically terminated.
Limitations on Use. Acumatica shall maintain in confidence, and shall not disclose to any third party, Subscriber Data, and Acumatica will not use Subscriber Data for any purposes other than the provision of the Service and as provided in Section 3.7 of this Agreement and Acumatica’s Privacy Statement.
