Limitations on Uses and Disclosures. Notwithstanding anything to the contrary in this Addendum or the Terms of Service, Business Associate: (i) may use or disclose Protected Health Information only if such use or disclosure is in compliance with this Addendum; and (ii) shall not use or disclose Protected Health Information in a manner that would violate HIPAA or the HITECH Act if done by Covered Entity, unless such use or disclosure is permitted by HIPAA and the HITECH Act for Business Associate.
