Common use of LIMITIATION OF LIABILITY Clause in Contracts

LIMITIATION OF LIABILITY. 26.1. The Authority accepts no liability for any consequences, whether direct or indirect, that may come about from the Grant Recipient delivering/running the Funded Activities, the use of the Grant or from withdrawal, withholding or suspension of the Grant. The Recipient shall indemnify and hold harmless the Authority, its Representatives with respect to all actions, claims, charges, demands Losses and proceedings arising from or incurred by reason of the actions and/or omissions of the Grant Recipient in relation to the Funded Activities, the non- fulfilment of obligations of the Grant Recipient under this Grant Funding Agreement or its obligations to Third Parties. 26.2. Subject to this paragraph 26, the Authority’s liability under this Grant Funding Agreement is limited to the amount of Grant outstanding.
