Limits of Obligation. The Company shall not be liable in any such case to the extent that any claim, loss, damage, liability, or expense arises out of any untrue statement (or alleged untrue statement) or omission (or alleged omission) made in such registration statement, including any preliminary or final prospectus, offering circular or other document, is based upon written information furnished to the Company by an instrument duly executed by such Holder or underwriter, and which is stated to be specifically for use therein.
Limits of Obligation. In any case, (i) any Holder's obligation under this Subsection 1(g)(2) shall extend only so far as the untrue statement (or alleged untrue statement) or omission (or alleged omission) is made in such registration statement, including any preliminary or final prospectus, offering circular, or other document in reliance upon written information furnished to the Company by an instrument duly executed by such Holder and which is stated to be specifically for use therein; and (ii) any Holder's liability under this Section 1(g)(2) shall not exceed the amount of proceeds to the Holder from the sale of its Registrable Securities in that offering.
Limits of Obligation. BC Hydro shall not be required to provide General Wheeling above the applicable Nominated Wheeling Demands under this Agreement unless otherwise agreed to in writing and in advance by BC Hydro. For greater certainty, any Energy Surplus or Energy Deficit at a Point of Interconnection will result in POI Imbalance Wheeling.
