LIQUIDATED DAMAGES FOR FAILURE TO MEET DEADLINE. 5.4.1. Where the Contractor fails to perform the tasks assigned to him within the time allowed by the order form then, without prejudice to actual or potential liability incurred in relation to this contract or to the contracting authority's right to terminate the contract, he shall be required to pay the Translation Centre liquidated damages calculated at the rate of 10% of the total amount to be paid for the assignment per calendar day of delay. 5.4.2. Liquidated damages are, however, limited to 50% of the total amount due for the assignment. 5.4.3. The liquidated damages shall be deducted from payments to be made to the Contractor, without prejudice to any direct recourse in the event of the amounts due being insufficient.
