Common use of Listing Application Clause in Contracts

Listing Application. Parent shall use its reasonable best efforts to cause the shares of Parent Common Stock to be issued as Merger Consideration to be approved for listing on the NASDAQ, subject to official notice of issuance, prior to the Effective Time.

Listing Application. Parent shall use its reasonable best efforts to cause the shares of Parent Common Stock to be issued as pursuant to this Agreement in the Merger Consideration to be approved for listing on the NASDAQNNM, subject to official notice of issuance, and to be reserved for issuance upon conversion of the Parent Preferred Stock and upon the exercise of New Options, prior to the Effective Time.

Listing Application. Parent shall use its reasonable best efforts take all action necessary to cause the shares of Parent Common Stock to be issued as in the Merger Consideration to be approved for listing on the NASDAQNASDAQ prior to the Effective Time, subject to official notice of issuance, prior to the Effective Time.

Parent shall each use its reasonable best efforts to cause the shares of Parent Common Stock to be issued as pursuant to this Agreement in the Merger Consideration to be approved listed for listing trading on the NASDAQ, subject to official notice NASDAQ National Market or on any securities exchange on which shares of issuance, prior to Parent Common Stock shall be listed at the Effective Time.
