Listing of the Shares. (a) On or before the First Closing Date, the First Closing Shares shall have been approved for listing on the Nasdaq Stock Market. (b) On or before the Second Closing Date, the Second Closing Shares shall have been approved for listing on the Nasdaq Stock Market.
