Common use of Listing; Other Action Clause in Contracts

Listing; Other Action. (a) If Twister Common Stock or any other securities to be acquired upon exercise of the Twister Option are then listed on the AMEX, Twister, upon the request of Tango, shall, at its expense, promptly file an application to list such shares or other securities on AMEX and will use reasonable best efforts to obtain approval of such listing on the AMEX, subject to notice of issuance, as promptly as practicable.

Listing; Other Action. (a) If Twister Tango Common Stock or any other securities to be acquired upon exercise of the Twister Tango Option are then listed on the AMEX, TwisterTango, upon the request of TangoTwister, shall, at its expense, promptly file an application to list such shares or other securities on AMEX and will use reasonable best efforts to obtain approval of such listing on the AMEX, subject to notice of issuance, as promptly as practicable.
