Common use of Lists of Holders Clause in Contracts

Lists of Holders. (a) The Guarantor shall furnish to the Guarantee Trustee a list of the names and addresses of the Holders ("List of Holders") in such form and as of such date as the Guarantee Trustee may reasonably require. The Guarantor shall furnish such List of Holders (i) within 30 days after receiving a written request from the Guarantee Trustee, such list to be as of a date no more than 15 days before such list is provided to the Guarantee Trustee, and (ii) unless the Trust Preferred Securities are represented by one or more Global Securities, at least one Business Day prior to the date for payment of Distributions, such list to be as of the record date relating to the payment of such Distributions. However, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor or at any time the Guarantee Trustee is the Registrar under the Trust Agreement. The Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in any List of Holders given to it, provided that the Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders. (a) The Guarantor shall furnish to the Guarantee Trustee (unless the Guarantee Trustee is otherwise the registrar of the Trust Securities) a list of the names and addresses of the Holders ("“List of Holders"”) in such form and as of such date as the Guarantee Trustee may reasonably require. The Guarantor shall furnish such List of Holders (i) within 30 days after receiving a written request from the Guarantee Trustee, such list to be as of a date no more than 15 days before such list is provided to the Guarantee Trustee, and (ii) unless the Trust Preferred Securities PIERS are represented by one or more Global Securities, at least one Business Day prior to the date for payment of Distributions, such list to be as of the record date relating to the payment of such Distributions. However, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor or at any time the Guarantee Trustee is the Securities Registrar under the Trust Agreement. The Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in any List of Holders given to it, provided that the Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall furnish or cause to be furnished to the QUIPS Guarantee Agreement Trustee (a) on a list quarterly basis on each regular record date for the Debentures, a list, in such form as the QUIPS Guarantee Agreement Trustee may reasonably require, of the names and addresses of the Holders of the Capital Securities ("List of Holders") in such form and as of a date not more than 15 days prior to the delivery thereof, and (b) at such date other times as the QUIPS Guarantee Agreement Trustee may reasonably require. The Guarantor shall furnish such List of Holders (i) request in writing, within 30 days after receiving the receipt by the Guarantor of any such request, a written request from the Guarantee Trustee, such list to be List of Holders as of a date no not more than 15 days before prior to the time such list is provided furnished, in each case to the Guarantee Trustee, and (ii) unless extent such information is in the Trust Preferred Securities are represented by one possession or more Global Securities, at least one Business Day prior to the date for payment of Distributions, such list to be as control of the record date relating to Guarantor and has not otherwise been received by the payment of such Distributions. HoweverQUIPS Guarantee Agreement Trustee in its capacity as such; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the QUIPS Guarantee Agreement Trustee by the Guarantor or at any time the Guarantee Trustee is the Registrar under the Trust AgreementGuarantor. The QUIPS Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in any List of Holders given to it, provided that the Guarantee Agreement Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Guarantor shall furnish such List of Holders (i) request in writing, within 30 days after receiving the receipt by the Guarantor of any such request, a written request from the Guarantee Trustee, such list to be List of Holders as of a date no not more than 15 days before prior to the time such list is provided furnished, in each case to the Guarantee Trustee, and (ii) unless extent such information is in the Trust Preferred Securities are represented by one possession or more Global Securities, at least one Business Day prior to the date for payment of Distributions, such list to be as control of the record date relating to Guarantor and has not otherwise been received by the payment of such Distributions. HoweverQUIPS Guarantee Agreement Trustee in its capacity as such; PROVIDED, HOWEVER, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the QUIPS Guarantee Agreement Trustee by the Guarantor or at any time the Guarantee Trustee is the Registrar under the Trust AgreementGuarantor. The QUIPS Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in any List of Holders given to it, provided that the Guarantee Agreement Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders. (a) The Guarantor shall furnish provide or shall cause the Trust to provide the Guarantee Trustee with a list list, in such form as the Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Securities ("List of Holders"), (i) in such form semi-annually, not later than _________ and ________ of each year and current as of such date date, and (ii) at such other times as the Guarantee Trustee may reasonably require. The Guarantor shall furnish such List of Holders (i) request in writing, within 30 days after receiving of receipt by the Guarantor of a written request from the Guarantee Trustee, such list to be Trustee for a List of Holders as of a date no more than 15 days before such list List of Holders is provided given to the Guarantee Trustee, and (ii) unless the Trust Preferred Securities are represented by one or more Global Securities, at least one Business Day prior to the date for payment of Distributions, excluding from any such list to be names and addresses received by the Guarantee Trustee in its capacity as of Security Registrar (as defined in the record date relating to the payment of such Distributions. HoweverIndenture), provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor or at any time the Guarantee Trustee is the Registrar under the Trust AgreementGuarantor. The Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in any List Lists of Holders given to it, provided that the Guarantee Trustee it may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Guarantor shall furnish such List of Holders (i) request in writing, within 30 days after receiving the receipt by the Guarantor of any such request, a written request from the Guarantee Trustee, such list to be List of Holders as of a date no not more than 15 days before prior to the time such list is provided furnished, in each case to the Guarantee Trustee, and (ii) unless extent such information is in the Trust Preferred Securities are represented by one possession or more Global Securities, at least one Business Day prior to the date for payment of Distributions, such list to be as control of the record date relating to Guarantor and has not otherwise been received by the payment of such Distributions. Howeverdistributions and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request from the Trust Guarantee Trustee for a List of Holders as of a date no more than 15 days before such List of Holders is given to the Trust Guarantee Trustee; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Trust Guarantee Trustee by the Guarantor or at any time the Guarantee Trustee is the Registrar under the Trust AgreementGuarantor. The Trust Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in any List Lists of Holders given to it, provided that the Trust Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.
