Common use of Lists of Holders Clause in Contracts

Lists of Holders. The Company covenants and agrees that it will furnish or cause to be furnished to the Trustee, semi-annually, not more than 5 days after each June 1 or December 1 in each year beginning with June 1, 2021, if and only if any Special Interest would be payable on the Notes on the immediately succeeding Special Interest Payment Date, and at such other times as the Trustee may request in writing, within 5 days after receipt by the Company of any such request (or such lesser time as the Trustee may reasonably request in order to enable it to timely provide any notice to be provided by it hereunder), a list in such form as the Trustee may reasonably require of the names and addresses of the Holders as of a date not more than 15 days (or such other date as the Trustee may reasonably request in order to so provide any such notices) prior to the time such information is furnished, except that no such list need be furnished so long as the Trustee is acting as Note Registrar.

Lists of Holders. The At any time any Notes are held as Physical Notes, each of the Company and the Reference Entity covenants and agrees that it will use commercially reasonable efforts to furnish or cause to be furnished to the Trustee, semi-annually, not more than 5 15 days after each June 1 or December 1 March 15 and September 15 in each year beginning with June 1March 15, 2021, if and only if any Special Interest would be payable on the Notes on the immediately succeeding Special Interest Payment Date2018, and at such other times as the Trustee may request in writing, within 5 30 days after receipt by the Company of any such request (or such lesser time as the Trustee may reasonably request in order to enable it to timely provide any notice to be provided by it hereunder), a list in such form as the Trustee may reasonably require of the names and addresses of the Holders as of a date not more than 15 days (or such other date as the Trustee may reasonably request in order to so provide any such notices) prior to the time such information is furnished, except that no such list need shall be required to be furnished by the Company or the Reference Entity so long as the Trustee is acting as Note Registrar.

The Company covenants and agrees that it will furnish or cause to be furnished to the Trustee, semi-annually, Trustee a list in such form as the Trustee may reasonably require of the names and addresses of the Holders of the Notes pursuant to Section 312 of the Trust Indenture Act: (a) semiannually and not more than 5 15 days after each June 1 or December 1 in each year beginning with June 1, 2021, if and only if the Regular Record Date for any Special Interest would be payable on the Notes on the immediately succeeding Special Interest Payment Date, and ; and (b) at such other times as the Trustee may request in writing, within 5 30 days after receipt by the Company of any such request (or such lesser time as the Trustee may reasonably request in order to enable it to timely provide any notice to be provided by it hereunder), a list in such form as the Trustee may reasonably require of the names and addresses of the Holders ) as of a date not more than 15 days (or such other date as the Trustee may reasonably request in order to so provide any such notices) prior to the time such information is furnished, except provided, that no such list need be furnished if and so long as the Trustee is acting as shall be the Note Registrar, such list shall not be required to be furnished.
