Litigating Subdivisions in Non-Eligible States. The Settling States will not encourage, facilitate, or assist in any manner whatsoever claims for Covered Conduct against Kroger in any Settling, Non-Settling, or Non-Eligible State, regardless of whether those claims were filed against Kroger prior to, on, or after the Effective Date.
