Common use of Litigation and Judgments Clause in Contracts

Litigation and Judgments. There is no action, suit, investigation, or proceeding before or by any Governmental Authority or arbitrator pending, or to the knowledge of Borrower, threatened against or affecting Borrower or any of its Subsidiaries, that would, if adversely determined, have a material adverse effect on the business, condition (financial or otherwise), operations, prospects, or properties of Borrower or any of its Subsidiaries or the ability of Borrower to pay and perform the Obligations. There are no outstanding judgments against Borrower or any Subsidiary of Borrower.

There are no outstanding judgments against any Borrower or any Subsidiary of BorrowerSubsidiary.
