Living Accommodation. The premises consist of the bedroom assigned to the Resident, together with fair use and responsibility of the shared unit facilities (hereinafter called the “Shared Unit Facilities”). Shared Unit Facilities include, but are not necessarily limited to, the kitchen(ette), bathroom, and living space.

Living Accommodation. 1. RESIDENT has selected and NEWBURY COURT shall provide to RESIDENT the living accommodation described as Suite # occupied by RESIDENT under this Agreement, hereinafter called the “Living Accommodation”). The Living Accommodation shall conform in all material respects to the plan furnished to RESIDENT in the form attached hereto as Exhibit 3. NEWBURY COURT reserves the right to make changes to the living accommodation at any time. Any change to the living accommodation by NEWBURY COURT shall not be deemed a material change so long as any such change does not reduce the square feet of the unit. RESIDENT shall have the exclusive right to occupy and use the Living Accommodation, subject to the terms and conditions of this Agreement and the laws and regulations of the United States, The Commonwealth of Massachusetts or any political subdivision thereof. The Living Accommodation will be available for occupancy on October 30, 2013, (hereinafter called “Occupancy Date”) provided, however, NEWBURY COURT shall not be liable for the failure to timely deliver the Living Accommodation due to fire, storm, earthquake or other casualty, or act of God or Force Majeure, by strike or lockout or other labor disputes of any kind, by government controls, or by other events or circumstances beyond the control of NEWBURY COURT. If RESIDENT has not paid the Entrance Fee in full on or before the Occupancy Date, then at the option of NEWBURY COURT, this Agreement may be immediately terminated, deposits refunded, and RESIDENT shall have no further rights to the Living Accommodation.
Living Accommodation. 7.01 Each occupant shall be provided with a single room of not less than eighty (80) square feet of floor space. The interior walls and ceilings of the room shall be covered with a suitable material properly finished. The floor shall be covered with a suitable material such as tile, or linoleum. Any rooms where flooring is replaced will be xxxx or tile flooring. Carpeting will be subject to the approval of the Camp Review Committee but in any event will be replaced by xxxx or tile flooring no later than January 1st 2005 with the exception of permanent camps as referred to in 6.03 (d). The room shall be properly insulated to guard against year- round climatic conditions and the walls between rooms shall be soundproofed with one-half (1/2) inch drywall and will have a layer of one-half (½) inch sound board on each side of the partitions between sleeping rooms. All walls to be insulated. Each room shall be fully enclosed with a door and a mortise-type lock and the occupant shall be supplied with one (1) key at no cost. Doors shall have a slot for room number or name. There shall be a weather-proof window of a size complying with the Alberta Building Code in each room which shall be covered by a screen and equipped with window blinds, venetion blinds, or drapes.
