Common use of Lost, Stolen, Destroyed or Mutilated Note Clause in Contracts

Lost, Stolen, Destroyed or Mutilated Note. Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Note and of indemnity arrangements reasonably satisfactory to the Company from or on behalf of the holder of this Note, and upon surrender or cancellation of this Note if mutilated, the Company shall make and deliver a new note of like tenor in lieu of such lost, stolen, destroyed or mutilated Note, at the Holder’s expense.

Lost, Stolen, Destroyed or Mutilated Note. Upon receipt by the Company of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Note and and, in the case of indemnity arrangements reasonably satisfactory loss, theft or destruction, of any indemnification undertaking by the Holder to the Company from or on behalf in customary form and, in the case of the holder mutilation, upon surrender and cancellation of this Note, and upon surrender or cancellation of this Note if mutilated, the Company shall make execute and deliver to the Holder a new note of like tenor Replacement Note (in lieu of such lostaccordance with Section 17(d)), stolen, destroyed or mutilated Note, at representing the Holder’s expenseOutstanding Principal Balance.
