(x) reorganization or similar laws measures, orders or proceedings affecting the rights of creditors generally; ;
(b) a receivertrustee, receiver and manager, liquidator, an administrator, trustee, custodian, sequestrator, conservator a receiver or a similar officer office includes a juge délégué, commissairecurateur, juge-commissaire, mandataire ad hoc, administrateur provisoire, liquidateur or curateur; a juge délégué;
(c) a lien person being “unable to pay its debts” includes that person being in a state of cessation of payments (cessation de paiements);
(d) a “lien”, “security” or “security interest interest” includes any hypothèque, nantissement, gage, privilège, sûreté réelle, droit de rétention, and any type of security in rem (sûreté réelle) or agreement or arrangement having a similar effect and any transfer of title (transfert à titre de garantie) by way of security; (d) a person being unable to pay its debts includes that person being in a state of cessation de paiements or having lost or meeting the criteria to lose its commercial creditworthiness; ;
(e) attachments or similar creditors process means an executory attachment (saisie exécutoire) or conservatory attachment (saisie arrêt); includes a saisie;
(f) a guaranty includes any garantie that is independent from the debt to which it relates and excludes any suretyship (cautionnement) within the meaning of Articles 2011 and seq. of the Luxembourg Civil Code; (g) by-laws or organizational constitutional documents includes its up-to-date (restated) articles of association (statutsstatuts coordonnés); and and
(hg) a responsible officer, financial officer, officer, authorized signatory, manager and director includes a gérant or an administrateur and a gérantadministrateur.
