Main Roads Clause Samples
The 'Main Roads' clause defines which roads are considered primary or significant for the purposes of the agreement. Typically, this clause will specify certain routes or highways that are designated as main roads, often for the purposes of access, maintenance responsibilities, or traffic regulations. For example, it may clarify which party is responsible for upkeep or improvements on these roads, or set standards for their use. The core function of this clause is to clearly identify and allocate responsibilities or rights related to major transportation routes, thereby preventing disputes and ensuring smooth operation or access.
Main Roads o The heavy equipment operators (Operators) who maintain the roads carry out a continuous campaign of leveling and smoothing of the driving surface of the roadway using a road grader and other necessary equipment. This maintenance includes periodic replacement of the driving surface, as necessitated by erosion and wear, using earthen material trucked from identified borrow-pit areas on Observatory property. o The Operators endeavor to minimize bumps, ruts, washboard surface, and loose rock material in the roadway. o To prevent erosion and other water related damage to the roadway, periodically the drainage channels along the main road are restored and the culverts are cleared of sediment and other obstructions. This is normally performed once per year, prior to the winter rainy season. o Operations management personnel conduct a driving inspection of the main roads on a daily basis and oversee the activities of the Operators. Management communicates with the Operators regularly to establish priorities for areas of the roadway requiring attention and to convey any special requirements or instructions.
Main Roads. (a) must give reasonable consideration to an Employee’s request to work on a modified basis, particularly where the request relates to an Employee’s caring responsibilities or phasing into retirement;
(b) may only refuse an Employee’s request to work on a modified basis if there are grounds to refuse relating to the adverse effect that agreeing to the request would have on the conduct of operations or business of Main Roads and those grounds would satisfy a reasonable person; and
(c) has the onus for demonstrating that there are grounds to refuse the Employee’s request that would satisfy a reasonable person.
