Maintainable Claims Against District Sample Clauses
Maintainable Claims Against District. The following claims by a Municipal Customer under this Agreement, and no others, may be maintained against the District:
(1) A claim that the District has not revised the Operating Plan as required by Article 4;
(2) A claim that the District is not using every reasonable effort to construct or fund the Capital Facilities as required by Section 5.1;
(3) A claim that the District has not revised the CFP then in effect as required by Section 3.2.2 to serve the demand of the Municipal Customer asserting the claim;
(4) A claim that the District is not delivering water to that Municipal Customer as required by Article 7; and
(5) A claim that the District has increased the Total Cost of the CFP without satisfying the requirements set forth in Article 14. A Municipal Customer may maintain, or seek redress respecting, such a claim only by instituting the procedures specified in this Section 16.1, instituted in the order in which they are set forth and within the periods specified, subject to extension pursuant to Section 17.1.
