Common use of Maintenance of Actions Clause in Contracts

Maintenance of Actions. As specified at Section 4.08, the Finance Committee shall have the authority to file any action, suit, or proceeding on behalf of the Trust or to enforce the obligations set forth in the Funding Payment Agreement. The Finance Committee shall also defend and arrange for the defense of any action, suit, or proceeding brought against the Trust, the Claims Administrator, the Finance Committee, or any agent or employee of the Trust.

Maintenance of Actions. As specified at Section 4.084.07, the Finance Committee shall have the authority to file any action, suit, or proceeding on behalf of the Settlement Facility or the Trust (as defined below) or to enforce the obligations set forth in the Funding Payment Agreement.
