Common use of Maintenance of and UBH Access to Records Clause in Contracts

Maintenance of and UBH Access to Records. Provider shall maintain adequate medical, treatment, financial and administrative records related to MHSA Services provided by Provider under this Agreement for a period and in a manner consistent with the standards of the community and in accordance with the Provider Manual, Protocols and all applicable state and federal laws, statutes and regulations. In order to perform its utilization management and quality improvement activities, UBH shall have access to such information and records, including claim records, within 14 days from the date the request is made, except that in the case of an audit by UBH, such access shall be given at the time of the audit. If requested by UBH, Provider shall provide copies of such records free of charge. During the term of this Agreement UBH shall have access to and the right to audit information and records to the extent permitted by the Provider Manual, or as otherwise required by state or federal laws, statutes or regulations or regulatory authority. Said rights shall continue following the termination hereof for the longer of three years or for such period as may be permitted by applicable state or federal law, regulatory authority, or Protocols. It is Provider's responsibility to obtain any Member's consent in order to provide UBH with requested information and records or copies of records and to allow UBH to release such information or records to Payors as necessary for the administration of the Benefit Plan or compliance with any state or federal laws, statutes and regulations applicable to the Payors. Provider acknowledges that in receiving, storing, processing or otherwise dealing with information from UBH or Payor about Members, it is fully bound by the provisions of the federal regulations governing Confidentiality of Alcohol and Drug Abuse Patient Records, 42 CFR Part 2; and Provider agrees that it will resist in judicial proceedings any effort to obtain access to information pertaining to patients otherwise than as expressly provided for in the federal confidentiality regulations, 42 CFR Part 2. This section shall not be construed to grant UBH access to Provider's records that are created for purposes of assessing Provider's financial performance or for Provider's peer review activities, except to the extent the federal and/or state government and any of their authorized representatives have access to such records pursuant to Section 6.3.

Provider shall maintain adequate medical, treatment, financial and administrative records related to MHSA the ability of the Provider to deliver Covered Services provided by Provider under this Agreement for a period and to Member in a manner consistent with the accepted standards of medical care prevalent in the community and in accordance with the Provider Manual, Protocols and all applicable state and federal laws, statutes and regulations. In order Such records shall include all medical records, documents, evidences of coverage and other relevant information in Provider’s possession upon which UBH relied to reach a decision concerning a Member complaint or grievance. Any such records shall be maintained for a period of six years and shall be readily available to UBH and Payor at all reasonable times during the term of this Agreement or a period of six years, whichever is longer. To perform its utilization management and quality improvement activities, UBH shall have access to such information and records, including claim claims records, at all reasonable times, and in any event, within 14 days from the date the request is made, except that that, in the case of an audit by UBH, such access shall be given at the time of the audit. Provider granting UBH access to medical records for audit purposes must be limited to only that necessary to perform the audit. If requested by UBH, Provider shall provide copies of such records free of charge. During the term of this Agreement UBH shall have access to and the right to audit information and records to during the extent permitted by the Provider Manual, or as otherwise required by state or federal laws, statutes or regulations or regulatory authority. Said rights shall continue following the termination hereof term of this Agreement and for the longer of three years following its termination, whether by rescission or for such period as may be permitted by applicable state or federal law, regulatory authority, or Protocolsotherwise. It is Provider's ’s responsibility to obtain any Member's consent in order to provide UBH with requested information and records or copies of records and to allow UBH to release such information or records to Payors as necessary for the administration of the Benefit Plan or compliance with any state or federal laws, statutes and regulations laws applicable to the Payors. In accordance with Washington law, Provider acknowledges that shall make medical records available to appropriate state and federal authorities involved in receivingassessing the quality of care or investigating the grievances or complaints of Members subject to applicable state and federal laws related to confidentiality of medical or health records. Such obligation survives the termination of this Agreement, storingwhether by rescission or otherwise. To the extent the Agreement allows UBH the right to audit Provider’s billing records, processing or otherwise dealing with information from UBH or Payor about Members, it is fully bound by Provider shall have the provisions right to audit UBH’s denial of Provider’s claims under the federal regulations governing Confidentiality same terms and conditions the Agreement sets forth for UBH’s audit of Alcohol and Drug Abuse Patient Records, 42 CFR Part 2; and Provider agrees that it will resist in judicial proceedings any effort to obtain access to information pertaining to patients otherwise than as expressly provided for in the federal confidentiality regulations, 42 CFR Part 2Provider’s billing records. This section shall not be construed to grant UBH access to Provider's ’s records that are created for purposes of assessing Provider's ’s financial performance or for Provider's ’s peer review activities, except to the extent the federal and/or state government and any of their authorized representatives have access to such records pursuant to Section 6.36.3 of the Agreement.
