Common use of Mandatory or Voluntary Restrictions Clause in Contracts

Mandatory or Voluntary Restrictions. Notwithstanding the provisions of Section 12.1, above, in the event City provides any utilities and any governmental entity promulgates or revises any statute, ordinance or building, fire or other code or imposes mandatory or voluntary controls or guidelines on City or the Premises or any Pole , relating to the use or conservation of energy or electricity, or in the event City is required or elects to make alterations to the Premises or any Pole to comply with such mandatory or voluntary controls or guidelines, such compliance and the making of such alterations shall in no event entitle Licensee to any damages, relieve Licensee of the obligation to pay the full Rent and additional charges reserved hereunder or to perform each of its other covenants hereunder or constitute or be construed as a constructive or other eviction of Licensee, provided that Licensee can still operate the Premises as Communications Sites.
