Common use of Mandatory provisions of the Act Clause in Contracts

Mandatory provisions of the Act. Where the Act implies terms in this agreement or gives rise to rights or obligations on the part of the Lessor or DHA which cannot be excluded, modified or restricted (“mandatory provisions”): (a) the Act overrides any term of this agreement which is inconsistent with the mandatory provisions; and (b) the mandatory provisions are deemed to be incorporated into this agreement to the extent of the inconsistency.
