Manufacturing Date Clause Samples

Manufacturing Date. GalaGen shall conduct appropriate studies in order to maximize the shelf life of the Ingredient. GalaGen agrees not to supply Ingredient which was manufactured more than three (3) months prior to delivery to Wyeth-Ayerst, unless otherwise approved, in writing, by Wyeth-Ayerst, such approval not to be unreasonably withheld.

Manufacturing Date. SDIX shall schedule its Manufacturing operations so that all Supplied Products delivered hereunder have the maximum shelf life possible and in any event no Supplied Products delivered hereunder shall have less than the shelf life set forth in the Specifications (the “Warranty Period”), assuming BD’s compliance with the requirements for storage and handling set forth in the Specifications. If any Supplied Product is delivered to BD whose shelf life does not conform to the requirements set forth in this Section 3.17, SDIX shall promptly, at its cost and expense, replace such Supplied Product.

Manufacturing Date. Almac shall schedule its Manufacturing operations so that, unless otherwise agreed in writing (Paratek’s agreement not to be unreasonably withheld, conditioned or delayed), at least [* * *] of the shelf life of the Products will remain on delivery of the Products.

Manufacturing Date. CIPAN shall schedule its Manufacturing operations so that all Products delivered have the maximum shelf life possible and in any event no Minocycline Starting Material delivered hereunder shall have less than [* * *] of shelf life remaining at the time of delivery. If Product is delivered to Paratek or Paratek’s designee whose shelf life does not conform to the requirements set forth in this Section 6.2, CIPAN shall promptly, at its cost and expense, refund or replace the non-conforming Product upon Paratek’s request.
