Market Purchases. Notwithstanding the provisions of the Confidentiality Agreement, Caza hereby consents to the acquisition by the Offeror and/or one or more of its affiliates, of Caza Shares other than pursuant to the terms of the Offer by way of open market purchases or otherwise, provided that such Caza Shares are acquired in accordance with applicable Securities Laws.
