Common use of Marketable Title Clause in Contracts

Marketable Title. Seller, shall convey good and MARKETABLE TITLE BY Special Warranty Deed, subject to general TAXES FOR THE CURRENT year not yet due and payable and utility easements which do not interfere with the present use of the Property. (A) Title shall be free from any and all liens or mortgages and Seller shall be responsible for any prepayment penalties necessary to deliver such free title.

Marketable Title. Seller, shall convey good and MARKETABLE TITLE BY marketable title by Special Warranty Deed, subject to general TAXES FOR THE CURRENT taxes for the current year not yet due and payable and utility easements which do not interfere with the present use of the Property.
