Marketing Activities; Marketing Materials; Third-Party Agents. Reseller shall use commercially reasonable efforts to actively market, promote, and distribute, at Reseller’s expense, the Products and Services solely within the Territory and solely under the terms of the Agreement. In selling the Products and Services, Reseller shall use only marketing materials supplied by Appgate or such other materials as have been approved in advance in writing by Appgate. Xxxxxxxx does not have the right to appoint or authorize any third party to act as a dealer, agent or reseller for the distribution of Products or Services without Appgate’s prior written consent.
