Common use of Marketing Violations Clause in Contracts

Marketing Violations. If FSSA determines that Contractor has violated the requirements of Contractor’s obligations with respect to marketing and marketing materials as set forth in Section 4.1 of the Scope of Work and 42 CFR 438.104, Contractor shall pay liquidated damages of nine hundred and fifty dollars ($950) for each instance that such determination of a violation is made. For illustration purposes only, a violation will be determined to exist if Contractor distributed, directly or indirectly through any agent or independent contractor, marketing materials that have not been approved by FSSA or that contain inaccurate, false or misleading information.
