MASTER AND CREW. 7.1 The Master shall carry out his duties promptly and the Vessel shall perform these services by day and by night in accordance with the Hirer’s requirements. 7.2 The navigation and management of the Vessel shall be in the exclusive control and command of its Owners, Master and crew.
MASTER AND CREW. 14.1 The Vessel (s) shall, at all times and as a minimum standard, be manned by personnel qualified and certificated in accordance with the requirements of Brazilian Regulations. 14.2 The Master and Officers shall be fluent, written and spoken, in the English language. Additionally a minimum of 3 officers, including the Master, shall be fluent, written and spoken, in Portuguese. 14.3 The Master, Officers and crew shall carry out their duties with the utmost despatch at all times as required by Enterprise. Provided always that the following operations are subject to the Master’s overall direction, supervision and responsibility and the Master’s right to refuse to obey any order which would endanger the Vessel or crew, all customary assistance shall be rendered, including but not limited to: a) loading, hooking on and discharging cargo by day or night as required by Enterprise and operating appropriate machinery on board the Vessel; b) hoisting, connecting and disconnecting fuel, offloading, water and pneumatic hoses, assistance for export hoses, tanker hang-off lines; c) subsea maintenance/ROV operations; and d) emergency response duties (including oil spill and safety activities). Owners shall procure that Enterprise shall have the right to communicate directly with the Master of the Vessel at all times. Owners shall not prevent the Master from communicating with Enterprise. 14.4 Not later than two months after the Charter has commenced, Owners shall ensure that both the Master and Relief Master shall have obtained Pilotage Exemption Certificates, if required, for the operation of the Vessel at Vitória, Macaé, Niterói and Rio de Janeiro. 14.5 Owners shall, at the request of Enterprise, promptly remove the Master or any officer or any member of the crew. Owners shall, at their own cost and expense, promptly replace such personnel with a suitably skilled and competent substitute.
MASTER AND CREW. (i) The Master shall carry out his duties promptly and the Vessel shall render all reasonable services within her capabilities by day and by night and at such times and on such schedules as the Charterers may reasonably require without any obligations of the Charterers to pay to the Owners or the Master, Officers or the Crew of the Vessel any excess or overtime payments. The Charterers shall furnish the Master with all instructions and sailing directions and the Master and Engineer shall keep full and correct logs accessible to the Charterers or their agents. (ii) The Master shall sign cargo documents as and in the form presented, the same, however, not to be Bills of Lading, but receipts which shall be non-negotiable documents and shall be marked as such. The Charterers shall indemnify the Owners against all consequences and liabilities arising from the Master, Officers or agents signing, under the direction of the Charterers, those cargo documents or other documents inconsistent with this Charter Party or from any irregularity in the papers supplied by the Charterers or their agents. (b) The Vessel's Crew if required by Charterers will connect and disconnect electric cables, fuel, water and pneumatic hoses when placed on board the Vessel in port as well as alongside the offshore units; will operate the machinery on board the Vessel for loading and unloading cargoes; and will hook and unhook cargo on board the Vessel when loading or discharging alongside offshore units. If the port regulations or the seamen and/or labour unions do not permit the Crew of the Vessel to carry out any of this work, then the Charterers shall make, at their own expense, whatever other arrangements may be necessary, always under the direction of the Master. (c) if the Charterers have reason to be dissatisfied with the conduct of the Master or any Officer or member of the Crew, the Owners on receiving particulars of the complaint shall promptly investigate the matter and if the complaint proves to be well founded, the Owners shall as soon as reasonably possible make appropriate changes in the appointment (d) The entire operation, navigation, and management of the Vessel shall be in the exclusive control and command of the Owners, their Master, Officers and Crew.   • Master Agreement Training A. The Employer and the Union agree that training for managers, supervisors and union stewards responsible for the day-to-day administration of this Agreement is important. The union will provide training to current union stewards, and the Employer will provide training to managers and supervisors on this Agreement. B. The Union will present the training to current union stewards within each bargaining unit. The training will last no longer than four (4) hours. The training will be considered time worked for those union stewards who attend the training during their scheduled work shift. Union stewards who attend the training during their non-work hours will not be compensated. The parties will agree on the date, time, number and names of stewards attending each session. The training will be completed by the parties within ninety (90) days of publishing or posting of this Agreement.
