Common use of Materiality of the Releases Clause in Contracts

Materiality of the Releases. The terms of the releases are a material part of this Settlement Agreement. If these releases or the Settlement Agreement cannot become effective for any reason and the Settlement set forth in this Settlement Agreement shall terminate as provided in Section XIII of this Settlement Agreement, then the releases shall terminate nunc pro tunc and be of no force and effect.
