Matters Excluded from the Dispute Resolution Processes. The following matters shall not be subject to Dispute Resolution or Schedule H (Arbitration): (a) rights granted to Inuit pursuant to Applicable Laws; (b) unauthorized disclosure of Confidential Information; (c) the right to terminate this Agreement and any notice of termination given by either Party; (d) any breach of the representations and warranties contained in this Agreement; (e) any breach of section 3.1.6 of this Agreement, and (f) any breach of section 9 (Suspension of Operations) of Schedule J (Wildlife), it being understood that either Party may at any time, notwithstanding section 7.4.2 of this Agreement, exercise any remedies as may be available pursuant to Applicable Laws to resolve any of the matters set out in this section 7.2.
